The application of the Davis-Bacon and Related Acts (DBRA) to federal and federally assisted construction projects leaves many contractors uncertain about the requirements of federal prevailing wage laws and the consequences of non-compliance. Failure to comply puts covered contractors at risk of catastrophic consequences, from high-dollar penalties to debarment from future federal work. This two-part webinar series seeks to help such contractors avoid those risks by educating staff tasked with DBRA compliance and administration on coverage, requirements, pitfalls, and enforcement of these laws.

Session 1 – Beginner Level

This session is perfect if you are a new staff person responsible for federal contract compliance or you’ve been in your role for a while and need a refresher course. This presentation will provide an introduction to DBRA coverage and how to read and interpret a wage determination. The training will also cover DBRA compliance principles, Wage and Hour Division’s investigative techniques, and the administrative process for concluding an investigation, including withholding contract funds and debarment.


Rebecca Clark

A native of Granite Bay, California, Rebecca Clark graduated from the University of California at Santa Barbara in 1997 with a BA in Political Science. She began with Wage and Hour’s San Francisco District Office as an investigator later that year. In 2007 Rebecca moved to the Western Regional Office to assist in the Government Contracts program, and in 2009 she assumed the position as the Regional Enforcement Coordinator for Government Contracts. Her responsibilities include planning the enforcement program for the 8 western states and the territories in the pacific, developing training for new and seasoned investigators, preparing cases for litigation, and supervising the government contracts team. Rebecca also had the opportunity to serve as the Acting Senior Davis Bacon Act policy advisor to then Branch Chief of Government Contracts, Tim Helm, at the agency’s national office in Washington, D.C. She is most comfortable in flip flops or steel toed boots.


Alexander J. Passantino


Seyfarth Shaw LLP

Mr. Passantino is a member of and the D.C. office leader for the firm’s Wage and Hour Litigation Practice Group. Mr. Passantino, the former Acting Administrator of the U.S. Department of Labor’s Wage and Hour Division, focuses his practice on all aspects of wage and hour law, including advising employers on federal and state wage and hour compliance issues, auditing payroll and employee classification practices, representing employers before the U.S. Department of Labor, and defending class and collective action litigation.
In his national practice, Mr. Passantino provides day-to-day advice and assistance to employers in their efforts to comply with the federal Fair Labor Standards Act and the state laws that require employers to pay overtime and minimum wages to their employees. In addition, Mr. Passantino provides guidance and counseling to government contractors who are subject to the Service Contract Act and the Davis-Bacon Act. He advises clients on implementing compliance programs, auditing and correcting wage and hour issues, and responding to the ever-changing wage and hour legal landscape. Mr. Passantino has also defended numerous wage and hour lawsuits, including both individual claims and class and collective actions.


Session 2 – Advanced Level

This session will perform a deeper dive into the intricacies and unique challenges of the laws. The second part of the training will be focused on contract clause 29 CFR 5.5(a)(6) – the regulation requiring prime contractors to keep their subcontractors and lower tired subcontractors in compliance. The “Best Practices Plan” that was developed by the US Department of Labor, Wage Hour and Division (WHD) with founding AGC member, Clark Construction, will be used to offer strategies for effectively policing subcontractors on DBRA covered projects.


Wayne T. Gray

Wayne Gray is Senior Director of Operations Finance for the Clark Construction Group, LLC, a national building and civil construction company specializing in integrated building solutions for more than 110 years. Clark is one of the largest privately held commercial construction companies by volume in the United States, consistently ranking in ENR’s top 15 general contractors.

Before assuming his current role in 2017, Wayne was tasked with overseeing Clark’s financial risk management activities through Enterprise Risk Management, Internal Audit, and Federal Submissions. His experience also includes work with Clark’s Financial Planning and Analysis, Cost Engineering, and Financial Accounting departments.


Courtney Christensen


Human Resource Manager

Courtney Christensen is a veteran of the construction industry working with the Clark Construction Group, LLC for more than 27 years. Currently, Courtney is the Human Resources Manager for several of Clark’s self-performed subsidiaries.

Before assuming her current role, Courtney served as a Regional Business Manager and responsible for overseeing Clark’s Business Management Department for the Mid-Atlantic Region. It was in this role that Courtney was tasked with overseeing compliance, accounting, and financial transactions for Clark Construction’s Mid-Atlantic Region projects.
